中文摘要: 尽管美国总统特朗普宣布退出《巴黎协定》,然而,从国际法的角度来看,美国并未真正退出该条约.因为《巴黎协定》的条文规定明显限制了美国的退约行为.对此,国际法形式主义理论认为,正是基于法律形式的存在,国际法对美国的退约行为产生了相应的制度粘性.未来,对中国而言,一方面,应重视《巴黎协定》后续规则构建中的形式要件,积极把握规则设计的剩余权力.另一方面,也应与美国开展富有成效的对话与沟通,以期促成全球温室气体减排.
英文摘要: The United States has not withdrawn from the Paris Agreement, despite the president Trump's announcement. This is because the Paris Agreement limited the withdrawal of the U. S. from its provisions. To this,legal formalism believe that legal form of international law has bought the institutional sticky against the U. S. withdrawing action,which demonstrates the normative power of international law. In the future,China would pay more attention to the form of elements about the Paris Agreement following rules,realize to lock power of discourse and remaining power into rules design as so to maintain China's core national interests in the global climate change institutional arrangements.
